REENGINEERING THE OFFICE OF THE PRESIDENT TOWARDS GREATER RESPONSIVENESS TO THE ATTAINMENT OF DEVELOPMENT GOALS

“WHEREAS, the Administration aims to advance development goals and uplift the quality of life of all Filipinos through a holistic, convergent, and participatory approach to leadership and governance;

“WHEREAS, the Office of the President consists of various agencies that carry out responsibilities pertinent to development and management, general government administration and internal administration;

“WHEREAS, the attainment of national development goals requires the efficient, responsive, and just allocation of resources by eliminating duplication or overlapping of common functions, maximizing research utilization with minimum disruption to operations, coordinating efforts more closely, sharing information, and consistently working in a collaborative manner;

“WHEREAS, the Executive Secretary, Cabinet Secretary, and Special Assistant to the President endeavor to proactively collaborate to promote the efficient delivery of services under the Office of the President;”

“Only by ending all armed conflicts, creating a safer society, and making the fruits of development more evenly distributed among its people can this nation hope to live up to the challenges it faces today. Through a careful identification of the national interests and what currently threaten such interests, 12 major national security goals have been outlined in this NSS. Every goal reached should bring the nation a step closer to its vision of a more peaceful, more prosperous and better future for the Filipino people.

“To achieve the national vision, the State must harness all resources at its disposal. This requires the whole government and other sectors of government to work together, shoulder-to-shoulder, in a well-planned, organized and synchronized manner toward the fulfillment of the 12-point national security agenda. All government departments and agencies should critically examine their policies and conduct their own internal assessment of their roles in realizing these national goals.

“Further reforms are needed in the national security sector to make it more efficient and proactive, able to respond quickly and effectively to national emergencies as they arise, and to predict and preempt crisis situations even before they arise. The national security community must make an effort to constantly seek self-perfection, hone and learn new skills, and overcome some of its most serious internal weaknesses related to turf issues and negative mindsets.

“Finally, this NSS requires no less than a whole-of-nation campaign. In our quest for meaningful change and a better future, every individual citizen, every sector of civil society, is enjoined to work hand-in-hand with the Government in the highest spirit of the Filipino people’s culture of ‘Bayanihan’.”

DIRECTING ALL GOVERNMENT DEPARTMENTS AND AGENCIES, INCLUDING GOVERNMENT-OWNED OR -CONTROLLED CORPORATIONS AND LOCAL GOVERNMENT UNITS TO ADOPT THE NATIONAL SECURITY POLICY 2017 – 2022 IN THE FORMULATION AND IMPLEMENTATION OF THEIR NATIONAL SECURITY RELATED PLANS AND PROGRAMS

“Section 3. Support from all Sectors. All sectors of society are encouraged to participate in this national endeavor for the purpose of achieving a holistic approach in addressing national security issues and priorities.”

AN ACT ESTABLISHING THE PHILIPPINE IDENTIFICATION SYSTEM

“SEC. 2. Declaration of Policies. – It is hereby declared the policy of the State to establish a single national identification system referred to as the “Philippine Identification System” or the “PhilSys” for all citizens and resident aliens of the Republic of the Philippines to promote seamless delivery of service, to improve the efficiency, transparency, and targeted delivery of public and social services, to enhance administrative governance, to reduce corruption and curtail bureaucratic red tape, to avert fraudulent transactions and misrepresentations, to strengthen financial inclusion, and to promote ease of doing business. Towards this end, a resilient digital system shall be deployed to secure the data collected and ensure that the people’s right to privacy, confidentiality and other basic rights are at all times upheld and protected.

“It is also the declared policy of the State to recognize the indispensable role of the private sector as the main engine of national growth and development, and to provide the most appropriate incentives to mobilize private resources for the purpose of promoting the use and ensuring maximum efficiency of the PhilSys as envisioned in this Act.”

INSTITUTIONALIZING THE WHOLE-OF-NATION APPROACH IN ATTAINING INCLUSIVE AND SUSTAINABLE PEACE, CREATING A NATIONAL TASK FORCE TO END LOCAL COMMUNIST ARMED CONFLICT, AND DIRECTING THE ADOPTION OF A NATIONAL PEACE FRAMEWORK

“WHEREAS, Executive Order No. 16, s. 2017 adopted the National Security Policy 2017-2022, which calls for the end of all armed threats in the Philippines and recognizes that internal socio-political stability rests upon healing the rifts that divide the nation by promoting participatory governance, synergy of government development efforts, and enhancing the participation and responsibilities of local government units (LGUs);

“WHEREAS, there is a need to reframe and refocus the government policy for achieving inclusive and sustainable peace by recognizing that insurgencies, internal disturbances and tensions, and other armed conflicts and threats are not only military and security concerns, but are symptomatic of broader social, economic and historical problems, such as poverty, historical injustice, social inequality, and lack of inclusivity, among others;

“WHEREAS, the Whole-of-Nation approach addresses the root causes of the insurgencies, internal disturbances and tensions, and other armed conflicts and threats by prioritizing and harmonizing the delivery of basic services and social development packages by the government, facilitating societal inclusivity, and ensuring active participation of all sectors of society in pursuit of the country’s peace agenda;

“WHEREAS, there is a need to create a national task force that will provide an efficient mechanism and structure for the implementation of the Whole-of-Nation approach to aid in the realization of the collective aspiration of the Filipino people to attain inclusive and sustainable peace;

“WHEREAS, to ensure comprehensive orchestration of related peace efforts and initiatives of national government agencies, local government units and various sectors of civil society, there is a need to formulate a National Peace Framework anchored on the Whole-of-Nation approach, which shall include, among others, a mechanism for local peace engagements or negotiations and interventions that is consistent with constitutional integrity and national sovereignty, responsive to local needs, and sensitive to realities on the ground,”

AN ACT PROVIDING FOR THE SPECIAL PROTECTION OF CHILDREN IN SITUATIONS OF ARMED CONFLICT AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF

“Sec 2 (e). Take all feasible measures to prevent the recruitment and use of children in armed conflict and shall take all necessary measures to ensure the effective implementation and enforcement of the provisions of this Act.

“Sec 2 (f). Take all necessary measures to address the root causes of the armed conflict including, but not limited to, poor governance, issues of injustice and widespread poverty and economic inequity that result in involving, affecting, or displacing children.”

AN ACT TO PREVENT, PROHIBIT AND PENALIZE TERRORISM, THEREBY REPEALING REPUBLIC ACT NO. 9372, OTHERWISE KNOWN AS THE “HUMAN SECURITY ACT OF 2007”

“The State recognizes that the fight against terrorism requires a comprehensive approach, comprising political, economic, diplomatic, military, and legal means duly taking into account the root causes of terrorism without acknowledging these as justifications for terrorist and/or criminal activities. Such measures shall include conflict management and post-conflict peacebuilding, addressing the roots of conflict by building state capacity and promoting equitable economic development;

 

“Nothing in this Act shall be interpreted as a curtailment, restriction or diminution of constitutionally recognized powers of the executive branch of the government. It is to be understood, however, that the exercise of the constitutionally recognized powers of the executive department of the government shall not prejudice respect for human rights which shall be absolute and protected at all times.”

STRENGTHENING THE POLICY FRAMEWORK ON PEACE, RECONCILIATION AND UNITY, AND REORGANIZING THE GOVERNMENT’S ADMINISTRATIVE STRUCTURE FOR THE PURPOSE

WHEREAS, the attainment of a just, comprehensive and sustainable peace, under the rule of law and in accordance with constitutional processes, is one of the primordial goals of the state in order to build a just, humane and progressive society;

WHEREAS, a just, comprehensive and enduring peace requires not merely the end of armed conflicts, but more importantly, the resolution of the root causes of the armed conflicts and social unrest, and the transformation of Philippine society to one characterized by justice, equity, tolerance, harmonious pluralism, and full respect for human rights; (underscoring ours) xxx

WHEREAS, to more effectively build on the achievements of the National Government on peacebuilding engagements over the last decade, there is a need to continually reassess and realign how policies and programs on peace processes are designed, implemented and monitored, and expand the framework on peace to include initiatives that reinforce national reunification and reconciliation, as part of enhancing resiliency, and social, political and economic reengineering; (underscoring ours) xxx

Section 1. Policy on Peace, Reconciliation and Unity. The framework for the implementation, coordination, integration, monitoring, and evaluation of all government initiatives on the peace process, reconciliation and unity shall be guided by the following:

“PRINCIPLES. The Comprehensive Peace Process shall be:

  1. “Conflict-sensitive and peace-promoting. It shall address the drivers and root causes of conflict. Peacebuilding interventions, programs and activities shall consolidate peaceful relations and strengthen viable political, socio-economic and cultural institutions to be capable of handling conflict, and enhance the capacity of other mechanisms to create or support the necessary conditions for sustained peace;
  2. “Whole-of-Society. There shall be continuing consultations, engagements and dialogues on both national and local levels to build consensus for whole-of-society peace agenda; and
  3. “Empowering. The government shall mobilize and facilitate the people’s meaningful participation, especially the vulnerable groups, towards social healing and reconciliation.”

“OBJECTIVES. The Goals and strategies of the Comprehensive Peace Process shall be anchored on:

  1. Embedding Peace, Reconciliation and Unity in the Social Fabric. There shall be direct and meaningful engagements with rebel groups and the affected communities at the grass-roots level in order to reach a peaceful settlement, and achieve a more permanent resolution to the conflict. Peacebuilding initiatives shall: (1) address the legal status and security of former rebels; (2) ensure the protection of non-combatants and reduce the impact of the armed conflict in affected areas; (3) provide for community-based assistance services that cater to the economic, social and psychological rehabilitation needs of former rebels, demobilized combatants, and civilian victims of the internal armed conflicts, especially women and children;
  2. Enhancing Resilience for Peace. Peace agreements shall strictly be implemented, and the enabling environment necessary to realize their goals shall actively pursued. Peace advocacy and peace education programs, and the implementation of various confidence-building, healing and reconciliation measures to improve relationships of trust within divided and broken communities, and between citizens and their government institutions, will be the core of peacebuilding strategies; and
  3. Social, Political and Economic Reengineering. There shall be government initiatives and mobilization of different sectors of society in addressing the root causes of internal armed conflicts and social unrest through the passage and implementation of key social, political and economic reforms requiring administrative action, new legislation or constitutional amendments.

Section 2. Administrative Structure The administrative structure to operationalize the policy framework on peace, reconciliation and unity shall be as follows: xxx

“xxx The PAPRU shall perform the following functions and responsibilities: xxx

  1. “Conduct regular dialogues with peace partners to seek relevant information, feedback and recommendations, as well as well as to render appropriate and timely reports on the progress of the comprehensive peace process to the President; (underscoring ours)
  2. “Recommend, as may be necessary, legislative and constitutional reforms toward lasting peace, unity and reconciliation; and
  3. “Perform such other functions as may be directed by the President.”
